Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Dashtxtastic service ("the Service"), operated by Wonderdev, LLC ("Wonderdev", "we", "us", "our"), a limited liability company organized under the laws of Florida.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Dashtxtastic is a web application that converts user-provided markdown documents into styled HTML dashboards, hosted in cloud storage and accessed by user-controlled share links. Paid tiers add programmatic access via API keys and AI-assisted design iteration powered by third-party large language models.
The Service is provided on an evolving basis. Features may be added, modified, or removed; we will use reasonable efforts to notify active users of material changes.
2. Accounts
You must be at least 16 years old to create an account. You agree to provide accurate registration information and to keep your credentials secure. You are responsible for all activity that occurs under your account, including activity by third parties you have authorized.
You may register using email and password or by signing in with a supported third-party identity provider (currently Google). Sign-in through a third-party provider is subject to that provider's own terms.
3. Acceptable Use
You agree not to use the Service to:
- Upload, generate, or distribute content that is unlawful, infringing, defamatory, harassing, obscene, or that violates the rights of others;
- Upload malicious code, malware, or content intended to phish, deceive, or harm any user or system;
- Attempt to circumvent rate limits, authentication, or access controls;
- Use automated means to scrape, mirror, or extract data beyond what is provided through the official API;
- Resell, sublicense, or commercially exploit the Service except as permitted by your subscription tier.
We may suspend or terminate accounts that violate this section without prior notice when necessary to protect users or the integrity of the Service.
4. Your Content
You retain all rights in the markdown documents, brand assets, and other content you upload ("Your Content"). You grant Wonderdev a limited, worldwide, royalty-free license to host, process, transform, and display Your Content solely for the purpose of operating and improving the Service and providing the features you have requested.
You are responsible for ensuring that Your Content does not infringe the rights of any third party and that you have all necessary permissions for any content you upload.
5. AI Features (Paid Tiers)
The "Iterate with AI" feature sends Your Content as prompts to a third-party large language model provider (currently Anthropic). Outputs are generated by an external system and are not guaranteed to be accurate, complete, or fit for any particular purpose. You are solely responsible for reviewing AI-generated output before publishing or relying on it.
Use of AI features is subject to a monthly token budget tied to your subscription tier. We may adjust budgets or pricing with at least thirty (30) days' notice.
6. Paid Subscriptions and Billing
Paid subscriptions are billed in advance through Stripe, our payment processor. By subscribing, you authorize recurring charges to your designated payment method until you cancel.
You may cancel at any time through the in-app billing portal. Cancellation takes effect at the end of your current billing period; we do not provide prorated refunds for partial periods except where required by applicable law.
We may change pricing for new billing periods with at least thirty (30) days' notice to active subscribers.
7. Service Availability
The Service is provided on a best-effort basis. We do not commit to any specific uptime, response time, or service level at this stage of the product. We may schedule maintenance windows or roll out changes that briefly interrupt availability.
8. Termination
You may close your account at any time through the in-app settings. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if continued service creates legal, security, or operational risk.
On termination, your data will be retained or deleted in accordance with our Privacy Policy. You may export your markdown source and generated dashboards through the account settings before closing your account.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that AI-generated output will meet your requirements.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WONDERDEV WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold Wonderdev harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or the rights of a third party.
12. Changes to These Terms
We may modify these Terms from time to time. Material changes will be communicated by email or in-app notice at least fourteen (14) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of Florida, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.
